Security Exceptions in Domestic and International Courts/Tribunals

The Centre for Trade and Investment Law (under the WTO Chairs Programme) recently hosted a Trade Talk on “Security Exceptions in Domestic and International Courts/Tribunals” at the Dr. Ambedkar International Centre, New Delhi, bringing focused attention to the rapidly expanding use of emergency powers and security exceptions in global trade and investment regulation. As governments increasingly invoke “security” to justify economic interventions-from tariffs and export controls to investment screening-the once-clear line between economic policy and national security is being redefined, and the session sought to unpack how these shifts are playing out across legal, constitutional, and policy frameworks. Hon’ble Justice S. Ravindra Bhat, Former Judge of the Supreme Court of India, delivered an incisive keynote address that examined the legal basis of security exceptions, the constitutional balances at stake, and the broader policy implications of this evolving trend. The panel discussion, moderated by Prof. (Dr.) James J. Nedumpara, Head of CTIL, featured distinguished speakers including Mr. Sanjay Chadha (Director, Public Policy-India & South Asia, Uber; Former Additional Secretary, MoCI), Mr. Sanjay Notani (Partner, Economic Laws Practice), Ms. Moushami P. Joshi (Senior Counsel, Husch Blackwell, USA), and Ms. Sujaya Sanjay (Associate, CTIL), who explored key themes such as the United States’ ongoing debates on emergency economic powers and tariff authority, the approach of WTO Panels and investment tribunals to the limits of “essential security interests,” and the implications of these developments for India’s regulatory and strategic space. We extend our sincere appreciation to all speakers, participants, and colleagues for contributing to this insightful discussion, which offered nuanced perspectives on a subject that continues to shape global economic governance, as security narratives increasingly drive trade policy, deeper legal reflection and informed dialogue remain essential, and this Trade Talk marked an important step forward in that direction.
