Seminar on Demystifying the IPR Chapter in the India–UK CETA

On September 15, 2025, the Department for Promotion of Industry and Internal Trade (DPIIT) and the Department of Commerce (DoC), in collaboration with the Centre for Trade and Investment Law (CTIL), organized a seminar on “Demystifying the IPR Chapter in the India–UK Comprehensive Economic and Trade Agreement (CETA)” at Vanijya Bhawan, New Delhi. The seminar focused on India’s first comprehensive IP chapter under any FTA, highlighting its novelty, nuances, and implications for innovation, development, and public interest. The inaugural session featured an introduction by Prof. (Dr.) James J. Nedumpara (Head, CTIL), followed by a keynote address from Ms. Himani Pande (Additional Secretary, DPIIT), a special address by Shri V. Lakshmikumaran (Legal Advisor, DoC) and a presentation on gains from the IPR chapter by Shri Karan Thapar (Director, DPIIT). These interventions set the stage for a deeper exploration of the chapter’s implications for trade, policy, and IP ecosystem. The first panel, moderated by Prof. Nedumpara, examined “Rethinking IP in Trade Policy: India’s Balancing Act in the CETA Framework,” while the second panel, moderated by Dr. Santanu Mukherjee (Ex Lege Chambers), turned to “Setting the Record Straight: Myth Busting in the IP Chapter.” The panel discussions featured distinguished experts, including Prof. Antony S. Taubman (Queen Mary University of London and Swinburne University of Technology), Dr. V. G. Hegde (former Prof., JNU), Dr. G.R. Raghavender (Senior Consultant (IPR), DPIIT), Dr. Niharika Sahoo Bhattacharya (IIT-Kharagpur), and Mr. Vipul Kumar Gupta (Cipla), Prof. (Dr.) Unnat P Pandit (CGPDTM), Mr. Eashan Ghosh (IPR Chair, NLU Delhi), Dr. Pratyush Nath Upreti (Queen’s University Belfast), Dr. Manisha Shridhar (WHO-SEARO, India), Mr. Munish Sudan (Tata Steel), and Mr. Nishant Sharma (Dolby). The experts demystified concerns surrounding the IPR chapter through in-depth deliberations on issues such as preference for voluntary licensing, issuance of compulsory licenses, government use of patents, protection of Indian geographical indications. The experts underscored that the IPR Chapter reaffirmed India’s commitment to a balanced, development-oriented IPR regime that fosters innovation while preserving essential policy flexibilities and offers new opportunities for growth, cooperation and effective protection of IP.
